We value the trust that you place in us by sharing your personal data. IQ-Pass takes your privacy seriously and is committed to handling your personal data in a way that is fair and worthy of your trust. IQ-Pass will take all reasonable steps to protect your information from misuse and to keep it secure. We collect, process and use personal data in accordance with the laws and regulations of the Netherlands as well as superordinate European legal requirements. We respect your privacy and would like for you to understand what we do with the information we collect about you. This privacy policy explains how we collect, protect, share and use your personal information.

IQ-Pass International B.V. (hereafter “IQ-Pass”, “we”, “us” or “our”), located at Keulschevaart 20, 3621 MX Breukelen in The Netherlands, is responsible for the processing of personal data and other necessary data as shown in this privacy statement.

—– SCOPE —–

IQ-Pass requires your consent to be able to process your personal data and other necessary data for the proper functioning of the IQ-Pass mobile app for the purposes listed in this privacy statement. You are being asked to give your consent to IQ-Pass by ticking the check box on the login screen to use the app. This privacy policy applies to all personal data that is collected and used by us after an GoWorkforce account is created for you by your employer or your client. After you agree with the privacy policy of IQ-Pass and our client, you have given permission within GoWorkforce for the use of data by us and/or our client. IQ-Pass requests the minimum amount of personal data to create an account for you, namely your first name, last name, e-mail address, communication language and employer. However, at the request of our client and / or for compliance with governmental laws and regulations, additional information may be required. For purposes of this privacy policy, ‘personal data’ means any information through which we can identify you, as further described below in ‘Personal Data We Collect’.

—– PERSONAL DATA WE COLLECT —–

General:

– Your names: Your first name or initials, your given name(s) and your last name to identify you as a person or a co-worker.

– Your E-mail address: as your unique identifier, as your username so that you can sign in to your own GoWorkforce account and manage your own personal data. Your E-mail address will also be used as your contact detail for notifications regarding, among other things, expiration of your documents and qualifications, etc.

– Your home and residence postal address for calamities and at the request of our client and / or government.

– Your telephone number for calamities, at the request of our client and / or for sending the SecureIDLink for a secure identification process.

– Your identification details: your nationality, date of birth, Dutch social security number, identification number and identification expiry date, at the request of our client and / or government to prevent identity fraud and illegal labor, as required by the Dutch and EU governments.

– Your photograph: at the request of our client for visual personal recognition.

Special categories of personal data:

On some projects you are requested by our client (s) to use the “Geofencing” functionality. In that case, you will be asked to give permission to track your location. With the “Geofencing” functionality, you can use the IQ-Pass mobile app on your smartphone to check in and out at a project location based on your current real-time location. In this way you can show our client during which period of time you have been present, and within which project location you have carried out work. The following data is collected when you actively use the “Geofencing” functionality within the IQ-Pass mobile app.

– Your location (geographical position) and the related timestamp for when you are actively checked in using “Check in” button.

– Your IP-address

– Your device platform (Android/iOS)

If you are not yet checked in, your location is only used in the mobile app to determine whether you are within a project’s boundaries or not. Your location will not be saved or collected if you are not checked in yourself.

We will only use location data you voluntarily provide us and only with your prior consent or under your direction to do so and only for the purposes set out in this Privacy Policy. You may refuse or revoke your consent at any time, as set out below (see ‘Your Rights’).

—– WHAT WE DO WITH YOUR PERSONAL DATA —–

IQ-Pass collects and uses your personal data for the purposes set out below. Please be informed that insofar IQ-Pass already holds information about you, IQ-Pass may use that information for the same purposes.

– Creating your own personal IQ-Pass account and credentials

– Identifying you as a unique person in our app

– Notifying you regarding your documents and qualifications requested by our/your client

– Risk minimization in the event of calamities on construction site

– Preventing identity fraud and illegal labor

– Compliance with government laws and regulations

– Compliance with client and site regulations

– Visual personal recognition

– Access control

– Time tracking bases on geographical position (Geofencing)

You can withdraw your consent at any time; see the section Your Rights below.

—– HOW WE SHARE YOUR DATA —–

You have been registered in IQ-Pass application by your employer or client because you are going to perform work.

– Employer: Your employer can act as contact person for our/your client on behalf of you as employee, at the request of our client. Therefore, your employer can view and manage your required personal data and documents so that your employer can prepare your further registration on the project and prove our client that you are qualified to work on the project.

– Client: Your/our client (s) can also view and manage your personal data and documents so that they can manage who are working within their location. They will also be able to manage whether everyone on their project is qualified in compliance with the applicable laws and regulations of the government and the client. Your data can only be shared with designated compliance controller(s) and other responsible persons for administrations and compliance tasks who are only allowed to view your data according to the GDPR.

– Government: Your personal data can, when requested, be shared with the government in order to comply with the applicable laws and regulations of the governments. This makes us able to prevent identity fraud and illegal labor etc.

– Third party providers: We share no personal data with third party providers for any purposes because the provided services are not person related and no personal data is required.

– You: From your own IQ-Pass account (web app and mobile app) you can always view your own data. You can also manage your own data or withdraw your consent to sharing your data with your employer or client, from your own IQ-Pass account in the web app. If you start working on another project where IQ-Pass application is applied, you will receive another request for consent for use of your data for the new work or project. You then use your existing IQ-Pass account on the web app to grant permission. You can always determine which organisation is allowed to view your data.

—– COOKIES, ANALYTICS AND PERSONALISATION —–

We use no (third party) cookies, analytics, personalisation or other mechanisms to automatically collect and record information about your activities in the mobile app and use of the services for any marketing, analytics and personalisation purposes. We do however collect your geographic position, but only when you use the “Geofencing” functionality. We request you for your consent to track your location when you check into a project for the first time. 

We store your login session and your choice of client environment and language within the login session on the mobile app for your convenience while using IQ-Pass mobile app.

—– IF YOU ARE UNDER 13 YEARS OF AGE —–

Our services do not address anyone under the age of 13 since labor for children under 13 is prohibited by law. We do not knowingly collect personally identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary actions.

—– SECURITY —–

IQ-Pass will take reasonable steps to ensure that your personal data is properly secured using appropriate technical, physical, and organizational measures. This makes the data protected against unauthorized or unlawful use, alteration, unauthorized access or disclosure, accidental or wrongful destruction and loss of data. Your personal data will be retained for as long as required for the above purposes or as long as necessary for compliance with statutory obligations and for solving any disputes.

—– DATA RETENTION —–

IQ-Pass retains your personal data for as long as required to satisfy the purpose for which they were collected and used (for example, the time tracking is necessary for our clients to pay wages and to store labor history). This applies unless a longer period is necessary for our legal obligations or to defend a legal claim. You can withdraw your consent to store / share your personal data at any time.

However if we or our clients need to store certain types of your personal data for a longer period due to legal requirements, we will store such data in accordance with the mandatory periods.

—– YOUR RIGHTS —–

You have the following rights concerning your personal data: right of access, right of rectification, right to erasure, right to restrict data processing, right to object against profiling and your right to data portability.

From your own IQ-Pass account (web app and mobile app) you can always view your own data. You can also manage your own data or withdraw your consent to sharing your data with your employer or client on your own IQ-Pass account in the web app. If you start working on another project where IQ-Pass application is applied, you will receive another request for consent at that time for using your data for the new work or project. You then use your existing IQ-Pass account on the web app to grant permission. You can always determine which organisation is allowed to view your data.

In case you may have a question or complaint about how we process your personal data, you can send an email to IQ-Pass or our/your client. 

—– CHANGES TO THE POLICY —–

We may change this privacy policy from time to time by posting the updated version of the privacy policy on our application. We will give you reasonable notice on our websites of any material change.
